{"id":1477,"date":"2023-03-17T15:00:25","date_gmt":"2023-03-17T21:00:25","guid":{"rendered":"https:\/\/visamia.com\/es\/?page_id=1477"},"modified":"2023-03-17T15:11:15","modified_gmt":"2023-03-17T21:11:15","slug":"benefits","status":"publish","type":"page","link":"https:\/\/visamia.com\/es\/benefits\/","title":{"rendered":"Benefits"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"1477\" class=\"elementor elementor-1477\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-10430c4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"10430c4\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-cfbbf32\" data-id=\"cfbbf32\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f741e69 elementor-widget elementor-widget-text-editor\" data-id=\"f741e69\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 id=\"ui-accordion-pagebody_accordion-header-4\" class=\"ui-accordion-header ui-helper-reset ui-state-default ui-accordion-icons ui-state-focus ui-accordion-header-active ui-state-active ui-corner-top\" tabindex=\"-1\" role=\"tab\" aria-controls=\"ui-accordion-pagebody_accordion-panel-4\" aria-selected=\"true\">Which benefits are included in public charge inadmissibility determinations?<\/h3>\nDHS will only consider public benefits as listed in the rule:\n<ul role=\"list\">\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"1\" data-listid=\"10\">Any federal, state, local, or tribal cash assistance for income maintenance<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"2\" data-listid=\"10\">Supplemental Security Income (SSI)<\/li>\n<\/ul>\n<ul role=\"list\">\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"1\" data-listid=\"10\">Temporary Assistance for Needy\u00a0Families (TANF)<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"2\" data-listid=\"10\">Federal, state or local cash benefit programs for income maintenance (often called \u201cGeneral Assistance\u201d in the\u00a0state\u00a0context, but which may exist under other names)<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"3\" data-listid=\"10\">Supplemental Nutrition Assistance Program (SNAP, or formerly called \u201cFood Stamps\u201d)<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"4\" data-listid=\"10\">Section 8 Housing Assistance under the\u00a0Housing Choice Voucher Program<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"5\" data-listid=\"10\">Section 8 Project-Based Rental Assistance (including Moderate Rehabilitation)<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"6\" data-listid=\"10\">Public Housing under\u00a0section 9\u00a0the Housing Act\u00a0of 1937, 42 U.S.C. 1437 et seq.<\/li>\n \t<li role=\"listitem\" aria-setsize=\"-1\" data-aria-level=\"1\" data-aria-posinset=\"7\" data-listid=\"10\">Federally funded Medicaid (with certain exclusions)<\/li>\n<\/ul>\nThis rule also clarifies that DHS will not consider the receipt of designated public benefits received by an alien who, at the time of receipt, or at the time of filing the application for admission, adjustment of status, extension of stay, or change of status, is enlisted in the U.S.\u00a0armed forces, or is serving in active duty or in any of the Ready Reserve components of the U.S.\u00a0armed forces, and will not consider the receipt of public benefits by the spouse and children of such service members.\u00a0The rule further provides that DHS will not consider public benefits received by children, including adopted children, who will acquire U.S. citizenship under INA 320, 8 U.S.C. 1431\u00a0or INA 322, 8 U.S.C. 1433.\n\nDHS\u00a0also\u00a0will not consider:\n<ol role=\"list\" start=\"1\">\n \t<li>The receipt of Medicaid\u00a0for the treatment of an emergency medical condition;<\/li>\n \t<li>Services or benefits funded by Medicaid but provided under\u00a0the\u00a0Individuals with Disabilities Education Act;<\/li>\n \t<li>School-based services or benefits provided to individuals who are at or below the oldest age eligible for secondary education as determined under\u00a0state\u00a0or local law;<\/li>\n \t<li>Medicaid benefits received by an alien under 21 years of age; or<\/li>\n \t<li>Medicaid benefits received by a\u00a0woman during pregnancy\u00a0and during the 60-day period beginning on the last day of the pregnancy.<\/li>\n<\/ol>\nThe final rule also clarifies that DHS will only consider public benefits received directly by the applicant for the applicant\u2019s own benefit, or where the applicant is a listed beneficiary of the public benefit. DHS will not consider public benefits received on behalf of another as a legal guardian or pursuant to a\u00a0power\u00a0of\u00a0attorney for such a person. DHS will also not attribute receipt of a public benefit by one or more members of the applicant\u2019s household to the applicant,\u00a0unless the applicant is also a listed beneficiary of the public benefit.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Which benefits are included in public charge inadmissibility determinations?
